dc.description.abstractNa doutrina jurídica, inexiste consenso acerca da natureza jurídica do nascituro. Ante a ausência de consenso, despontam três teorias (natalista, personalidade condicionada e a concepcionista) que tentam explicar as particularidades do nascituro, além do tratamento jurídico a ser dispensado a ele. No presente artigo, tem-se a apresentação geral de cada uma dessas correntes, destacando os principais pontos e com a exemplificação de julgados que as adotaram. Trata.se um estudo de cunho qualitativo amparado em materiais documentais e bibliográficos. Ao final, foi possível concluir que as correntes teóricas refletem, cada qual à sua maneira, a natureza única do nascituro e que, ao contrário do que os defensores dessas teorias sustentam, inexistem motivos para que apenas uma vertente teórica seja adotada pelo ordenamento jurídico, bem como o assunto permanece relevante e deve ainda ser discutido no âmbito acadêmico.
dc.description.sponsorshipIn the legal doctrine there is no consensus about the legal nature of the unborn child. In the absence of consensus, three theories emerge (natalist, conditioned personality and conceptionist) they try to explain the particularities of the unborn child, as well as the legal treatment to be dispensed to it. In this article, there is the general presentation of each of these theories, high lighting the main points and exemplification of judgments that adopted them. It is a qualitative study supported by documents and bibliographic materials. In the end it was possible to conclude that the theoretical currents reflect, each in its own way, the unique nature of the unborn child and that, on the contrary to what the defenders of these theories maintain, there are no reasons for only one theoreticals trend to be adopted by legal system, as well as the subject remains relevant and should still be discussed in the academic context.
